George Alan Kelly’s Trial Regarding His Arrest for Second-Degree Murder and Aggravated Assault

George Alan Kelly, a 74-year-old Arizona rancher, is set to go on trial on Friday after being arrested and charged with second-degree murder and aggravated assault. The charges stem from an incident where he defended his wife and property from illegal invaders on his ranch in Kino Springs, located just outside of Nogales, Mexico, on January 30, 2023.

Reports indicate that the deceased individual, Gabriel Cuen-Butimea, had a history of illegally crossing into the United States and had faced multiple deportations. Mr. Kelly’s defense lawyers have stated that he fired warning shots after observing a group of men dressed in camouflaged attire aiming an AK-47 directly at him.

It is noted that George Alan Kelly intentionally shot above the individuals’ heads to avoid causing harm. Subsequently, when Mr. Kelly went to check on his horse, he discovered the deceased illegal alien, whom it is believed could be affiliated with a cartel smuggling operation.

Initially charged with first-degree murder, Mr. Kelly’s charge was recently amended to second-degree murder during an evidentiary hearing in court. The trial, taking place at Santa Cruz County Superior Court, is expected to last approximately a month as the case unfolds amidst the national discourse on border security, particularly amid this year’s upcoming presidential election.

Additionally, George Alan Kelly had turned down a plea deal that would have reduced the charge to negligent homicide if he had chosen to plead guilty, as per Fox News and as reported by the Associated Press.
