Judicial Decision Denying Trump’s Mistrial Motion
Judge Juan Merchan has made the decision to reject the motion put forth by former President Donald Trump’s legal team for a mistrial in light of Stormy Daniels’s testimony regarding an incident where she allegedly spanked him with a magazine. The ruling came after intense arguments from both the prosecution and defense teams.
Prosecution’s Response
According to a report by CNN, prosecutors vehemently contested the claims made by Trump’s legal team regarding the newness of the spanking story. Prosecutor Joshua Steinglass refuted these claims, stating that most of the allegations made by Trump’s lawyers were outright false.
“Starting with the fact that it’s a new account – this is not a new account,” Steinglass emphasized. He further dismissed the defense’s assertions of an ambush and changing of the story as baseless.”
It was highlighted by the prosecution that the focus of Daniels’s testimony was not on the interaction in question, with only eight questions being directed at her regarding the encounter with Trump. Despite this, prosecutors argued that her testimony was relevant as it shed light on Trump’s potential motives for engaging in later criminal activities.

Ultimately, Judge Merchan sided with the prosecution, marking the second consecutive denial of a mistrial request by Trump’s legal team within a span of two days.
