Donald Trump’s Attempt to Obtain a New Trial in E. Jean Carroll Case Rejected by Judge Kaplan

Former President Donald Trump’s recent legal maneuver to secure a new trial in the E. Jean Carroll case was decisively rebuffed by Judge Lewis Kaplan. In his ruling, Judge Kaplan unequivocally dismissed Trump’s argument as lacking any legal or factual basis, emphasizing numerous key points raised in Ms. Carroll’s opposing legal memorandum.

One crucial aspect highlighted by the judge was the unequivocal determination by both the jury and the Court that Trump’s statements on June 21 and 22 were incontrovertibly false, defamatory, and made with clear malice—both in actuality and within the purview of common law.

Moreover, Judge Kaplan underscored the extensive reach of the defamatory statements, emphasizing that they were viewed between at least 85 to 104 million times. In stark contrast, there was a complete dearth of evidence regarding the dissemination of The Cut article, which Trump attempted to attribute as the sole cause of damages suffered by Ms. Carroll—despite not even being alleged to be defamatory.

Furthermore, the judge noted that Trump’s argument glaringly overlooked the impact of the June 21 and 22 statements on Ms. Carroll, as testified by her during the trial. This willful blindness to crucial evidence and legal principles, coupled with the absence of compelling legal precedents to support Trump’s stance, rendered his argument untenable.

In a scathing appraisal, Judge Kaplan highlighted the incongruity between the arguments presented by Trump and the established legal principles governing causation in cases of defamation. The judge affirmed that the jury, as the trier of fact, had rightly assessed causation, a determination that the Court should defer to absent extraordinary circumstances.

Therefore, Judge Kaplan concluded that Trump’s argument, characterized by its lack of merit, failure before the jury, and disregard for common sense, did not warrant dismissal as a matter of law.

Despite the resounding legal setbacks and judicial rulings against him, Donald Trump shows no signs of relenting in his attempts to circumvent compensating E. Jean Carroll.
