Legal Battle Unfolds Over Alleged Censorship of Republican Legislator

In a recent development, Republican Michigan State Representative Matt Maddock has taken legal action by filing a case in federal court. The crux of the matter revolves around the allegation that the Democrat Speaker, Joe Tate, is preventing criticism by sitting legislators of Democrat policies and elected officials. Maddock is seeking a judicial ruling declaring this censorship unconstitutional under the First Amendment.

The case demonstrates the legislature’s use of its authority to silence conservative elected officials within its ranks. Maddock’s communications with citizens were reportedly censored by the legislature, as evidenced by the exhibits attached to the complaint.

Speech Restrictions Under House Rules

  • Criticizing the legislature
  • Criticizing fellow legislators
  • Criticizing the Governor
  • Anything deemed “partisan”
  • Impugning motives of groups like lobbyists

Even the phrase “Taxation is theft” was deemed off-limits by the House under Democrat control. Attorney Marc Randazza, representing Maddock, described the case as an “epic First Amendment case” highlighting the blatant violation of free speech rights by the Michigan government.

Maddock sent text for a digital newsletter to civil servants working for Speaker Tate in Michigan’s capital. These employees enforced rules prohibiting criticism of Governor Gretchen Whitmer, allegations of voter fraud in the 2020 election, and discussions of divisive issues.

In an exclusive statement, Maddock expressed concerns about the suppression of dissent by the militant left in power across America. Recent incidents, such as the punishment of Rep. Josh Schriver for retweeting a post about demographic trends, underscore the extent of censorship faced by conservative legislators.

Legal battles and smear campaigns have been employed to undermine conservative voices like Maddock and his wife, who is currently facing prosecution by Michigan’s far-left Attorney General, Dana Nessel.

Supreme Court and Free Speech

The U.S. Supreme Court has rejected prior restraint, emphasizing the protection of free speech rights. Mentioning an upcoming Supreme Court case involving the Gateway Pundit’s Publisher, Maddock emphasized the importance of safeguarding free speech in the face of censorship.

The Michigan case, Maddock v. Michigan, filed in the Western District of Michigan, Southern Division, highlights the parties involved and the legal battle ahead. Speaker Tate’s office has been contacted for comment, but no response has been received.
