‘We are losing equal justice under the law’

A recent commentary published in the Washington Examiner highlights the alarming transformation of America into a “3rd World” nation due to the actions of New York Attorney General Leticia James and Judge Arthur Engoron. Their joint efforts have culminated in a staggering $450 million penalty imposed on President Donald Trump and his business under an outdated fraud law, despite the absence of any complaints, financial losses, or outstanding loans.

Elizabeth Stauffer, a fellow at the Heritage Foundation Academy, emphasized the detrimental impact of this prosecutorial overreach on the fundamental principle of equal justice under the law, which distinguishes the United States from Third World countries. James’ threats to seize Trump’s New York assets if he fails to pay the exorbitant fine further underscore the abusive nature of the legal proceedings.

The ruling by Engoron, attributing liability to Trump for allegedly inflating asset values on bank loan applications, overlooks the standard industry practice of adjusting valuations before loan approval. All loans were promptly repaid, and testimonies during the trial indicated the desire of loan officers to engage in further business with Trump due to his lucrative opportunities.

Shark Tank star Kevin O’Leary condemned the partisan manipulation of the legal system as an assault on America’s economic foundation, characterized by its adherence to due process and property rights. The erosion of these core principles poses a significant deterrent to future investments in New York and other Democratic-led cities, creating uncertainty for prospective investors.

Stauffer and O’Leary concur that the repercussions of James and Engoron’s actions transcend individual grievances, impacting the nation’s credibility and attractiveness to global capital. The prioritization of short-term gains over long-term consequences jeopardizes the stability and integrity of the legal system, warranting a call for responsible governance and oversight.
