The Department of Justice Clears Attorney General Merrick Garland of Contempt Charges

The Department of Justice has informed Speaker Mike Johnson that they will not prosecute Attorney General Merrick Garland for contempt of Congress. Assistant Attorney General Carlos Uriarte wrote to Johnson stating that Garland’s responses to the congressional subpoenas did not constitute a crime, and therefore, no further action will be taken against him.

House Republicans, who previously attempted to impeach Secretary Mayorkas, pushed for Garland’s prosecution in hopes of obtaining tapes from an interview conducted by Special Counsel Robert Hur with President Biden. Despite their efforts, Biden has invoked executive privilege over the tapes, preventing their release even if Garland wanted to do so.

In compliance with the subpoena, the Department of Justice has provided full transcripts of the Biden/Hur interview to the House Republicans. However, the DOJ has expressed concerns that the recordings could be misused for political purposes, including deep fakes that could pose a threat to national security.

The Department of Justice has denounced the political nature of the request for the recordings and affirmed that AG Garland did not commit any crime, thus will not face prosecution.
